Terms of service
1. Acceptance
By accessing or using the services of MaxMenu Inc. ("MaxMenu", "we"), you ("User", "Restaurant", "Partner") accept these Terms of Service. If you do not agree, do not use the platform.
2. Description of service
MaxMenu provides digital menu infrastructure, table ordering (Order & Pay) and payment processing through third parties (Stripe Connect). This includes a management dashboard, public URL, embeddable widget and tools for design, translation and allergen compliance.
3. Accounts and eligibility
- You must provide accurate information and keep it up to date.
- You are responsible for the security of your access credentials.
- For Order & Pay you must complete Stripe Connect onboarding and meet legal requirements in your jurisdiction.
4. Plans, billing and fees
Subscription plans, prices and transaction commissions are described at maxmenu.com/pricing. MaxMenu may change fees with reasonable prior notice. Guest fees for Order & Pay are shown transparently at checkout.
5. Restaurant content
You retain ownership of your menu content (text, images, prices). You grant MaxMenu a limited licence to host, display and distribute that content through the platform and widget. You are responsible for the accuracy of prices, allergens and applicable legal information.
6. Payments
Payments are processed by Stripe. MaxMenu is not a payment institution. You accept Stripe's terms applicable to your connected account. MaxMenu is not responsible for holds, disputes or chargebacks handled by Stripe or card issuers.
7. Acceptable use
You may not:
- Use the platform for illegal or fraudulent activities.
- Attempt unauthorised access to systems, data or third-party accounts.
- Reverse-engineer, mass scrape or intentionally overload the infrastructure.
- Resell the service without a partnership agreement (Agency programme).
8. Availability
MaxMenu aims for high availability but does not guarantee uninterrupted service. Scheduled maintenance and force majeure may temporarily affect access. See the technical documentation for architecture details and component SLAs.
9. Limitation of liability
To the maximum extent permitted by law, MaxMenu shall not be liable for indirect damages, loss of profits or business interruption. Total aggregate liability is limited to amounts paid to MaxMenu in the twelve months preceding the event giving rise to the claim.
10. Changes and termination
We may update these terms by publishing the revised version on this page. You may cancel your account at any time. MaxMenu may suspend accounts that breach these terms.
11. Governing law
These terms are governed by the laws of the State of Delaware, United States, without prejudice to mandatory consumer protection rules in the User's jurisdiction where applicable.
